- What should the customer know about your pricing (e.g., discounts, fees)?
The initial consultation is free, unless we agree otherwise. Usually I give a flat fee for a new client. Depending on the nature of the work (wills or trusts or an operating agreement), I often do flat fees. For employment litigation (plaintiff), it's a contingency. For contract litigation or employment defense its hourly. Probate litigation just depends. For general corporate work, that is typically hourly (license agreements, merger agreement etc).
- What types of customers have you worked with?
We prepare a good number of operating agreements, shareholders' agreements, shareholder buyout or departure agreements, buy-sell agreements, and employment and non-compete agreements. We also prepare offering documents to help companies raise capital and comply with Federal and State securities law. If asked, we also prepare wills or other types of miscellaneous legal documents, like leases, guaranties, licenses, subordination agreements, security agreements. We represent clients in Federal or State courts with respect to business disputes (e.g., shareholder disputes, dispute over an asset purchase agreement, patent infringement). We also have product liability experience (plaintiff).
- What advice would you give a customer looking to hire a provider in your area of work?
It helps us to have a complete description of the issues facing a client so we can appropriately advise you. We are happy to listen to your situation for 5 or 10 minutes, without charge, to see if we can be of assistance to you. It helps to shop around and compare prices. We try to give a fixed fee or a fee fixed within a range the first time we represent a client. It helps to be up-front about your business and financial situation: for clients who are financially stressed or small, we try to accommodate and "right-size" our deliverable. The same is true for prosperous clients with complex needs: small details in complex multi-year agreements often have large economic consequences and part of our job it to see these in context and bring these to your attention and get them right. Our clients are the decision makers; we don't tell them what to do but rather help to provide them with the advice, counsel and documents to accomplish their goals. Accordingly, it helps to be clear about what you want.
